1. Acceptance of Terms

By creating an account or using ABA Therapy Resources ("the Platform," "we," "us"), operated by The ABA Collective, LLC, you agree to these Terms. If you don't agree, don't use the Platform.

2. What This Is

ABA Therapy Resources is a marketplace connecting buyers and sellers of digital resources for behavior analysts and related professionals: data sheets, templates, visual supports, and similar materials. We provide the platform. We do not create, review for clinical accuracy, or guarantee the quality of any listed resource.

3. Eligibility

You must be 18 or older to create an account. You do not need to be a licensed clinician to buy or sell on the Platform, and no credential is required or implied by anything sold here.

4. Accounts

One account covers both buying and selling. You're responsible for your login credentials and everything that happens under your account. Notify us immediately if you suspect unauthorized access.

5. Selling on the Platform

Content ownership. You must own or have the right to sell everything you list. Uploading someone else's copyrighted work, including reproductions of copyrighted assessment tools, is prohibited and grounds for removal and account termination.

Moderation. Every listing is reviewed before it goes live. We may reject, remove, or request changes to any listing at our discretion, including after it's already live.

File restrictions. Only approved file types may be uploaded (PDF, DOC/DOCX, PPT/PPTX, XLS/XLSX, PNG, JPG, ZIP). Executable files, HTML, or any file type capable of running code are prohibited.

Fees. We currently take a 15% fee on each sale (10% for sellers on the Store subscription tier). Fees may change with notice. Payment processing is handled by Stripe; by selling on the Platform, you agree to Stripe's Connected Account Agreement.

Taxes. You're responsible for your own tax obligations on income earned through the Platform. Stripe provides relevant tax documentation directly to sellers using Standard Connect accounts.

No employment relationship. Selling on the Platform does not make you an employee, contractor, or agent of The ABA Collective.

6. Buying on the Platform

License. Purchasing a resource grants you a personal or single-practice license to use it, not a right to resell, redistribute, or share it outside your own use, unless the listing explicitly states a broader license (e.g., a site license).

Refunds. Digital goods are non-refundable once downloaded. This is standard for digital marketplaces. In rare cases (a corrupted file, a listing that doesn't match its description, or a similar clear error), we may issue a refund at our discretion.

7. Prohibited Conduct

No uploading malicious files, harassing other users, creating fake reviews, circumventing the moderation queue, or using the Platform for anything unlawful.

8. Content Ownership and License to Us

You retain ownership of what you upload. By listing something, you grant us a license to host, display, and process it for sale through the Platform.

9. Copyright Policy

We respond to valid copyright takedown notices under the DMCA. See our separate DMCA Policy for how to submit one.

10. Disclaimers

Resources on this Platform are created by third-party sellers, not by us, and are not reviewed for clinical accuracy or appropriateness for any specific case. Nothing on the Platform is a substitute for professional clinical judgment, supervision, or training. We make no warranty about the accuracy, completeness, or fitness of any listed resource.

11. Limitation of Liability

To the fullest extent permitted by law, The ABA Collective is not liable for indirect, incidental, or consequential damages arising from your use of the Platform or any resource purchased through it.

12. Indemnification

You agree to indemnify The ABA Collective against claims arising from content you upload or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms. Continued use after changes means you accept the updated version.
